Can I change my mortgage broker/realestate agent before a buyers/sellers contract is signed?

Posted on November 30th, 2009 by admin in realestate agent | 5 Comments »

I have a broker/agent, that I can never get in touch with. Never met her personally. She is the sellers grandaughter. Very frustrating when you have questions and she never has time for you. I want to get an agent that is there all the time and explains all the moves. What should I do?

Unless you have a contractual obligation to the current broker/agent, CHANGE.

Did you sign a buyers agreement with her? As for the mortgage broker ive never heard of anybody signing a mortgage broker agreement. I dont even think they are legal at least where I live. You can change your mortgage company at anytime.

In our state you cant be both the Real Estate agent and Mortgage Broker. Its one or the other.

I would suggest calling another Real Estate Broker and asking them the laws for your state and have them look at what you signed.

I agree. You should contact another real estate agent. That way you would have someone working on your behalf as a buyer’s agent. The granddaughter is working on the seller’s behalf as a seller’s agent.

You have no contractual obligation to a mortgage broker, you can kick them to the side at any time. You may not get your application fee, or appraisal fee, etc. back. Also, I am not aware of any contractual obligation to a realestate broker as a buyer. If you are selling a home, and you sign a seller’s agreement for 60, 90, or 180 days, then you are locked in somewhat. My suggestion is to get your own realtor (you are paying for one in the sell price of the home anyway unless grandma has a special deal with the grandaughter). That way, your realtor can answer your questions, guide you in signing the sales contract, and spend his/her time trying to pin down the other broker. Good luck !

I don’t understand why you would choose an agent to represent you that is related in any way shape or form to the seller… get your own agent. She won’t care for you, she’ll care for the seller… FIND YOUR OWN AGENT, SOON!!!

You have to get your own agent. Your agent needs to care for you and your interests.
